In many respects this is a blessing. Once the mortgagee takes possession of the unit there is a very simple answer for recovery of the outstanding levies.
Can I stop the body corporate committee acting in an irrational way?
We can give you advice on whether you have rights against the committee and whether you can do anything to prevent the actions they are taking. Needless to say, this must be assessed on a case by case basis. We have seen examples of both body corporate committees acting irregularly and also, lot owners acting irrationally.
What can I do if a lot owner is being unreasonably obstructive?
Many disputes are resolved through the Office of the Commissioner for Body Corporate and Community Management. They have the capacity to conciliate disputes and also to adjudicate on disputes. We can assist you in your approach to the Commissioner and if necessary, we can assist you drafting documentation to be submitted.
